2. Services:

Buter Up offers a variety of marketing services, including:

  • Social media management (Instagram, Facebook, and potentially other platforms)

  • Website design and development

  • Content creation and scheduling

  • Social media advertising

  • Analytics and reporting

The specific services you receive will be outlined in your Service Agreement.

3. Client Access and Permissions:

To effectively manage your social media accounts and website, you grant Buter Up the following permissions:

  • Access to your Facebook and Instagram accounts, including the ability to publish content, respond to messages, and manage settings.

  • Access to your website backend for design and development purposes.

  • Access to all necessary information and materials related to your brand and marketing goals.

You retain full ownership and control of your accounts and website. The permissions you grant are solely for the purpose of fulfilling the agreed-upon services.

4. Data Privacy and Security:

Buter Up takes your data privacy seriously. We collect and use data from your accounts and website only for the purposes of providing our services and improving our platform. We will not share your data with any third-party without your express consent.

We implement robust security measures to protect your data from unauthorized access, disclosure, alteration, or destruction. You can learn more about our data privacy practices in our separate Privacy Policy.

5. Client Responsibilities:

You are responsible for:

  • Providing accurate and complete information about your accounts and website.

  • Reviewing and approving all content created by Buter Up before it is published.

  • Complying with all applicable laws and regulations related to your online activities.

  • Maintaining control of your account passwords and access.

6. Limitation of Liability:

Buter Up will use commercially reasonable efforts to fulfill its obligations under these Terms. However, we are not liable for any damages resulting from:

  • Your misuse of our services.

  • Technical or security breaches beyond our control.

  • Third-party services or platforms beyond our control.

7. Termination:

You or Buter Up may terminate this agreement at any time with written notice. We may also terminate your access to the services if you violate these Terms or fail to pay your fees.

8. Dispute Resolution:

Any dispute arising out of or relating to these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be held in Eagle Lake, Minnesota.

9. Entire Agreement:

These Terms constitute the entire agreement between you and Buter Up regarding the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

10. Amendment:

Buter Up may amend these Terms at any time by posting the amended Terms on its website. The amended Terms will be effective immediately upon posting.

11. Severability:

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

12. Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of laws provisions.
